Introduction

These terms and conditions apply to all services provided by Amelie Dimech, trading as Amelie Designs, based in Malta. By engaging my services or using this website, you agree to be bound by these terms.

These terms do not affect your statutory rights. Where a separate written agreement exists between us for a specific project, that agreement will take precedence.

Services

Amelie Designs offers freelance graphic design, visual identity, web design, and related creative services. The specific scope of work for each project will be agreed upon in writing before work begins, typically via a project brief, proposal, or quote document.

I reserve the right to decline any project at my discretion, including work that conflicts with my values or professional standards.

Project Process

All projects begin with a written agreement confirming the scope, timeline, and fee. Work will not commence until a deposit has been received (see Payment section).

You are responsible for providing accurate, complete, and timely information, content, and feedback required for the project. Delays caused by late or incomplete information from the client may affect the agreed timeline and could result in additional charges.

I will communicate project progress and share work at agreed milestones. Approval at each stage must be confirmed in writing before the next phase begins.

Payment

A non-refundable deposit of 50% of the agreed project fee is required before work begins. The remaining balance is due upon project completion, prior to the delivery of final files.

Invoices are issued in Euros (€) and are payable within 14 days of the invoice date unless otherwise agreed in writing. Late payments may incur interest at 2% per month on the outstanding balance.

All quoted fees are exclusive of any applicable taxes. Expenses agreed in advance (such as stock photography, font licences, or printing costs) will be invoiced separately.

Intellectual Property

All design work created by Amelie Dimech remains the intellectual property of Amelie Dimech until full payment has been received. Upon receipt of final payment, ownership of the final agreed deliverables transfers to the client for the agreed use.

I retain the right to display all completed work in my portfolio, on my website, and in promotional materials, unless explicitly agreed otherwise in writing.

Working files (such as layered Photoshop or Illustrator source files) remain the property of Amelie Dimech unless their transfer has been specifically included in the project scope and agreed in writing.

You warrant that any content, images, or materials provided to me for use in the project do not infringe the intellectual property rights of any third party.

Revisions

Each project includes a specified number of revision rounds as agreed in the project proposal. Revisions are defined as reasonable amendments within the original scope — not changes to the project brief or direction.

Revisions beyond the agreed number, or changes that significantly alter the original scope, will be quoted and charged separately at my standard hourly rate.

Cancellation

Either party may terminate a project with written notice. If you cancel a project after work has begun, the deposit is non-refundable. If work beyond the deposit value has been completed, you will be invoiced for the time and work completed up to the point of cancellation.

If I am unable to complete a project due to unforeseen circumstances, I will notify you as soon as possible and refund any fees paid for work not yet delivered.

Limitation of Liability

My total liability for any claim arising from a project will not exceed the total fee paid for that project. I am not liable for any indirect, consequential, or incidental loss, including loss of profit or business opportunity.

I am not responsible for the performance of third-party services, hosting providers, printing companies, or other suppliers involved in a project.

You are responsible for ensuring that any work produced is legally compliant for its intended use, including trademark clearance for logos and copyright clearance for any third-party content.

Website Use

The content of this website — including text, images, and design — is the property of Amelie Dimech and may not be reproduced, copied, or distributed without prior written permission.

This website is provided for informational purposes and I make no warranty that it will be uninterrupted or error-free. Links to third-party websites are provided for convenience only; I am not responsible for their content or practices.

These terms are governed by the laws of Malta. Any disputes will be subject to the exclusive jurisdiction of the Maltese courts.
